1 - General Terms

By using the Nin Nin Game Website, THE BUYER (The Buyer) AGREES TO BE BOUND BY ITS TERMS OF USE, LEGAL NOTICES, PRIVACY POLICY and all other policies that appear on the Nin Nin Game Website.

N2G Export, LLC reserves the right to make changes to the Nin-Nin-Game.Com Website and its Terms of Use and Legal Notices at any time. Each time the Buyer uses the Nin-Nin-Game.Com Website, the Buyer should visit and review the then current Terms of Use, Legal Notices and Privacy Policy that apply to the Buyer’s transactions and use of this site. If the Buyer is dissatisfied with the Nin Nin Game Website, its content or Terms of Use and Legal Notices, the Buyer agrees that his sole and exclusive remedy is to discontinue using the services on Nin Nin Game Web site.

The Buyer agrees to be perfectly aware that his agreement concerning the contents of these Terms of Use, Legal Notices and Privacy Policy does not require the handwritten signature of this document, insofar as the customer wishes to order online the products presented within the framework of the Nin Nin Game Website. The consumer has the faculty to safeguard or to print the present general terms, being specified the printing of this document concerns his own responsibility.

The Buyer states to have full legal capacity allowing him to engage under the present general terms.

2 - Contract and Orders

2-1 Prices

Prices on the Nin Nin Game Website are indicated in Japanese Yen, Euro, USD (see the dropdown menu for the complete list of currencies) and do not include delivery fees and VAT.

Only the price specified in the invoice may be considered as final. Invoice prices include price of the products, handling/packaging fees, storage, and delivery costs.

2-2 Product Description

The company N2G Export, LLC, presents on its Nin Nin Game website products for sale. Products are described with necessary details the Buyer shall be aware of before filling-in an order form.

There is no restriction on the number of items that the Buyer may order, in the extent of the available stock displayed on the Nin Nin Game Website. Indication on the availability of the product s confirmed at the time of ordering.

The company N2G Export, LLC has the right to modify and/or replace the products at any time, depending on the products offered for sale by its distributors.

Photographs, and/or graphics depicting a product are only displayed as additional information and N2G Export, LLC shall not be liable for them.

In the case when a supplier modifies a product, N2G Export, LLC shall not be liable for the accuracy of its graphic representation and this shall not by any means affect the validity of the order.

2-3 Order / Sale

This sale is subject to, and Seller's acceptance is conditioned upon, Buyer's assent to the terms and conditions stated herein and on the face hereof, which are in lieu of and replace any and all terms and conditions set forth in any documents issued by the Buyer, including, without limitation, purchase orders and specifications. Any additional, different, or conflicting terms and conditions on any such document issued by the Buyer at any time are hereby objected to by the Seller, and any such document shall be wholly inapplicable to any sale made hereunder and shall not be binding in any way on the Seller.

On the date of signing the order form, the Buyer validates the general conditions of sale. The general conditions of sale will apply from the signing of the order form until the delivery of the order to the Buyer by the company N2G Export, LLC.

After placing an order, the Buyer shall receive an automatic email confirming the order and notifying him of the details of his order. He shall be informed of further evolutions until shipment of the order (by email, and by accessing “Nin-Nin Game > My Account > History”).

The order shall only be held as final when the Buyer receives the confirmation notice, and when N2G Export, LLC receives the entire payment for the order.

The company N2G Export, LLC strongly recommends that the Buyer keep a hardcopy of such information concerning his order.

2-4 Cancellations

Nin-nin-game.com does not accept cancellations. If the Buyer absolutely has to cancel an order (error of the ordered product (s), etc.), the Buyer must contact the customer service as soon as possible. Depending of the product ordered,the time and the order history of the buyer a solution might be given. In the case a cancellation is accepted and a refund needs to be done, it will be under a credit store/voucher. 

3 - Payment

The Buyer shall complete full payment of his order, at the time of his order. In no way shall any kind of payment completed to N2G Export, LLC be considered as a partial or advance payment (to the exception when "Pay-Later" is available on certain Pre-Orders)

Payment is completed to N2G Export, LLC when the Buyer validates his order.

All orders may be paid with the aforementioned available currencies.

The Buyer may complete his payment by means of: online credit card payment / Paypal, International money transfer, European money transfer, French money transfer, or a variety of other Payment methods proposed by Adyen or Ebanx.

The Buyer certifies the company N2G Export, LLC that he is cleared to use the chosen means of payment at the time of completing his order.

The company N2G Export, LLC reserves the right to suspend or cancel any order and / or shipment in the case of non payment of any amount due by the Buyer, or in the case of payment failure, whatever the current status of fulfillment of the order.

Penalties equivalent to five points above current legal interest rates shall be applicable to late or unpaid amounts, in a period of 10 business days after completing order, or when a means of payment used by the Buyer is rejected. Shipment of any other order shall be suspended in the case of any late payment of the current order.

The company N2G Export, LLC reserves the right to ask for a copy of official identification documents from the Buyer, for any payment by credit card

As a counter measure to internet fraud and to better protect the Buyer from such fraud, N2G Export, LLC reserves the right to share some information with other parties for verification purposes.

4 - Shipment and Delivery

4 - 1 General Terms

The products are delivered to the address indicated in the order form by the Buyer, who undertakes to take delivery of the products ordered. On delivery, the Buyer is obliged to check the condition of the packaging and the goods, and indicate any damages to the company N2G Export, LLC within 7 business days following the delivery, by email.

The Buyer shall chose a shipment method through the Nin Nin Game Website. Available shipment method are: economic SAL, Airmail, Registered Airmail, EMS, and FEDEX/DHL. Shipment costs are calculated automatically at the time of order.

A notification email is sent to the Buyer when his order is shipped. The Buyer may follow the evolution of his order through his personal account on the Nin Nin Game Website.

Average time of shipment from N2G Export, LLC's warehouse to Europe / the Americas are as followed:

- Registered Economic SAL : 15 to 20 business days

- Registered Airmail: 5 to 10 business days

- EMS : 3 to 4 business days

- FEDEX/DHL : 2 to 3 business days

Please bear that those are average values, and provided as informational. Shipment may take more time, depending on mail traffic conditions.

Any shipment taking more time than indicated as above, does not give right to any kind of compensation, suspension, or cancellation of the order by the Buyer.

4 - 2 Problems of Quality or Non-conformity

In the case of receiving a product that differs with the order (malfunctioning or non-conform), the Buyer must file his claim within 7 business days of receiving the shipment.

Claims shall be sent as Registered Airmail to N2G Export, LLC at the aforementioned address, and must include:

- The Buyer's address and identity.

- The references of the product.

- The motivations of the claim.

Product returns shall be done within 7 business days from the attribution of a return identification number by N2G Export, LLC's Service Center.

In any other case, N2G Export, LLC may not proceed in any refund or any exchange of returned products.

All products to be exchanged or refunded shall be returned as Registered Airmail to N2G Export, LLC in their original packaging. The products must be complete with all their accessories, as in the original order.

Shipping costs are to be paid by the Buyer.

The Buyer remains responsible for all risks and damage resulting in the return of his shipment.

In the case of non compliance to the above procedure, the Buyer may not file any claim for non-conformity or defect of the delivered products.

5 - Guarantee

Only video game systems & accessories are subject to guarantee, for a length of one year and in Japan only. This guarantee covers only production defects (damage due to shock or the presence of liquid is not covered by guarantee).

If the Buyer were to encounter a problem with a video game system or accessory bought on the Nin Nin Game Website in one years time from the order, he may contact N2G Export, LLC and send back the product at his own cost (as Registered Airmail only , to : N2G Export, address aforementioned). N2G Export, LLC shall then send the product back to the maker in order to exercise product guarantee. N2G Export, LLC shall ask the Buyer to participate in subsequent delivery cost when repair is completed or product is exchanged.

All returns are subject to N2G Export, LLC's explicit agreement. No return shall be accepted by N2G Export, LLC without such agreement.

In no event shall the company N2G Export, LLC be liable for any indirect, special, incidental or consequential damages resulting from the company’s performance or failure to perform under this sale, or the furnishing, performance or use of any, whether due to a breach of contract, breach of warranty, strict liability, the negligence of the company N2G Export, LLC, or otherwise. The company N2G Export, LLC is not the producer of the products it presents in its Nin Nin Game Website. The Buyer expressly understands and agrees that the the company N2G Export, LLC cannot be held responsible for any deficiency in the products.

6 - Unforeseen Circumstances

The company N2G Export, LLC shall not be liable for any delay in performance directly or indirectly caused by or resulting from acts of God, fire, flood, natural disasters, accident, riot, war, government intervention, embargoes, strikes, labour difficulties, equipment failure, late delivery by suppliers or any other difficulties which are beyond the reasonable control of the company N2G Export, LLC, such as a general lack of the goods and services required to establish the service contracted, unforeseeable delays on the part of suppliers or other third parties on which the company N2G Export, LLC depends and general transport problems. This includes also any failure of any electronic device and/or difficulties with communications networks. During the periods of Unforeseen Circumstances the obligations of either party shall be suspended. The party concerned by the Unforeseen Circumstances shall immediately advise the other within ten working days on the date the Unforeseen Circumstances had occurred. In the delay of one month, the parties will come together and check whether their contractual obligations shall be furthermore suspended or not. The contractual obligations can be terminated by the injured party if the Unforeseen Circumstances are still valid after a period of three months.

7- Partial Non Validation

If one or several provisions of these general sales conditions are considered or declared invalid in application of a law, a regulation or the final decision of any competent jurisdiction, the other provisions shall remain in full force and effect.

8- Non Waiver

The fact that one of the parties fails to exercise it rights with regard to a breach by the other party of any obligation whatsoever specified hereunder, shall not be construed in the future as any waiver of the breach concerned.

9 - Headings

The section headings used herein are for convenience or reference only and do not form a part of these terms and conditions, and no construction or inference shall be derived therefrom.

10 - Governing Law

In case of dispute, the Buyer shall come to an amicable settlement with the company N2G Export, LLC. These Terms & Conditions of Use are solely governed by Japanese Law.

11 - "Informatique et Libertes" Privacy Law

By ordering via the Nin Nin Game Website, the Buyer consents to the use by the company N2G Export, LLC of the personal information about the Buyer which he has given or which has been collected over the Nin Nin Game Website. This information is needed for the company N2G Export, LLC to process your order.

According to article 78-17 of the "Informatique et Libertés" law of 6 January 1978 on the processing of personal data, the Buyer has a right of access, rectification and deletion of the data that is held about him.

To exercise this right, the Buyer should send an email to the company N2G Export, LLC.

The company N2G Export, LLC may share the personal information collected with any third parties of their choice involved in the supply of the products proposed. Such information is provided when necessary to the performance of the services and is kept in strict confidence.
